Privacy Policy

Introduction

This Privacy Policy discloses the privacy practices for WETS Enterprises Ltd. ("us", "we ", "our " or "the Company") with respect to information collected from Users who access our website at www.wets.ca ("Website"), how we use that information, and to whom we may disclose the information collected.

By accessing our website located at www.wets.ca and when you use our Customer Portal (collectively our "Website") or when you use our mobile app (the "Mobile App") or by otherwise providing personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter "Personal Information") to us in connection with our services, you agree to the terms of this Privacy Policy. If you do not agree with these terms, exit this page and do not access or use this Website, do not use our Mobile App, and do not provide personal information to us. Our Website and Mobile App are collectively called our "Digital Properties" in this Privacy Policy. 

The Personal Information we collect from you through our Digital Properties is necessary to provide you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject. When you use our Digital Properties, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy. We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions. 

In using any of our Digital Properties, you have the ability to control the amount of Personal Information you provide to us and can restrict the use and disclosure of Personal Information we collect from you by not providing Personal Information in connection with our Digital Properties. By using any of our Digital Properties or by providing Personal Information in connection with your interactions with us, we will assume that you have consented to the collection, use and disclosure of your Personal Information as set out in this Privacy Policy unless you advise us otherwise. We receive your Personal Information from various sources:
  • When you voluntarily provide us your personal details in order to register on our Digital Properties;
  • When you use or access our Digital Properties in connection with your use of our services;
  • From third party providers, services and public registers (for example, traffic analytics vendors).

Email Communication: We may collect Personal Information when you subscribe to our email list, download content, to respond to information requests, or to keep you informed of our latest updates. We send administrative or promotional emails as permitted under applicable local laws governing email communication for these purposes. Administrative emails include communication related to our swim lessons and programs. Promotional related emails will relate to the promotion of our programs, services and products. You can opt out of our email communications by using the unsubscribe mechanism in any message you receive from us or by contacting us at the address provided in this Privacy Policy;


Account Registration Information: We may collect Personal Information when you create an account through our Digital Properties for the purposes of registering for lessons or programs, providing services, or purchasing products;


Internet, Electronic Network and Device Information: We collect Personal Information from Users engaging with our Digital Properties for security processes, monitoring traffic patterns, site usage, and related site information. We may automatically collect or compile information when you access our Digital Properties. Such information includes geolocation data, IP address, the dates and times of visits to our website, the pages of the website visited, content accessed, and the browsers, operating systems, search engines, and search terms used, which relates to your activity through our Digital Properties. We use this information in order to optimize our Digital Properties and to assess usage of our Digital Properties.

SHARING INFORMATION

Except as provided in this Privacy Policy, we will not share your personal information with third parties. We may share your information with certain third party service providers. These third parties perform certain functions on behalf of us such as processing credit card payments, hosting and operating our Digital Properties, storing and processing information on our behalf, or performing research, technical diagnostics, or analytics. These service providers will have access to your personal information solely for the purposes of providing such limited functions to us.

We may share information collected with designated team members at any one of our locations that you have registered at for swim lessons or in which you have expressed interest. Our team members, including independent contractors are required by contract to keep your information confidential and they may use this information only in accordance with the terms of the contract.

We may also disclose information when we believe that it is appropriate or reasonably necessary to: (i) comply with any applicable law, regulation, or court order; (ii) enforce our policies, including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

User Rights

To use certain parts of our Digital Properties, you may be required to create an account and to provide certain personal information in connection with that account. You may access and modify your account at any time. You may request to: 
  • Receive confirmation of the personal information collected, and access your stored personal information, together with supplementary information. 
  • Receive a copy of personal information you directly provided to us in a structured, commonly used and machine-readable format. 
  • Request a correction of your personal information that is in our control.
  • Request erasure of your personal information. 

children's personal information

We do not knowingly collect Personal Information from children under the age of 19 through our Digital Properties. We expect that the parent or guardian of the child will be responsible for providing Personal Information of the child through use of our Digital Properties, including the process of creating an account, providing information on the child, and registering for lessons or any of our programs. We collect personal information of a child in connection with their registration in our swim programs, including name, address, age, gender, swim ability, progress, attendance, programs used, health concerns and any other related information necessary to provide our services.

Retention

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account related documents, communications and anything else as required by applicable laws and regulations. 


We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

We and our trusted partners use cookies and other technologies in our related services, including when you visit our website or access our services. 


A "cookie" is a small piece of information that a website assigns to your device while you are viewing a website. Cookies can be used to navigate between pages efficiently, enable automatic activation of certain features, remembering your preferences and making the interaction between you and our Services quicker and easier.


The website uses the following types of cookies:

Cookies do not contain any information that personally identifies you. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of our website may not operate properly and your online experience may be limited.


We also use a tool called “Google Analytics” to collect information about your use of our website. Google Analytics collects information such as how often users access our website and what pages they visit. We use the information we get from Google Analytics only to improve our website and services. Google Analytics collects the IP address assigned to you on the date you visit sites. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to our website is restricted by Google Analytics' Terms of Use and Google's Privacy Policy.

Third party collection of information

Our Privacy Policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 


This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy. 

SECURITY

We take precautions to protect Users information and to maintain the security of our Digital Properties. When Users submit Personal Information through our Digital Properties, we employ industry standard procedures and policies to ensure the safety of your Personal Information is protected, and to prevent unauthorized use of any such information. Only authorized personnel including independent contractors who need to access your Personal Information to perform a specific job are granted access to personally identifiable information. Further, we require any third party to comply with security requirements, in accordance with this Privacy Policy. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Digital Properties, and we make no warranty, express, implied or otherwise, that we can prevent such access.

Corporate transaction

We reserve the right to transfer or disclose Users' Personal Information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Updates or amendments to this Privacy Policy

We reserve the right to periodically amend or revise this Privacy Policy and material changes will be effective immediately upon the display of our revised Privacy Policy. The last modification date will be reflected at the top of this Privacy Policy. Your continued use of our Digital Properties, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to our Privacy Policy.


Limited Nature  

Nothing included in this Privacy Policy is intended to create a contract or agreement between us and you and you may not interpret or rely on it as such.
